In case it is of interest, I've attached a short and just-published piece about the US constitutional problems with concluding ACTA as a sole executive agreement. It's co-authored by Oona Hathaway (Yale Law, prominent expert on foreign relations law and executive power), and published in the American Society of International Law "Insights" series, which is fairly widely read in the community of international lawyers.
