Perhaps of interest: I've just published this short article about the Novartis case in the New England Journal of Medicine. It makes a set of arguments that will be familiar to people here – i.e. that the Novartis case struck an important blow for access, and that Section 3(d) should be a model for other countries — not only because it promotes access, but because — if adopted widely -- it might encourage companies to focus on breakthrough innovation rather than incremental innovation.
