WIPO to decide next steps on 1) the Artist’s Resale Right, 2) Copyright in
the Digital Environment, and 3) Theatre Directors

On 20 April 2018, the World Intellectual Property Organization (WIPO)
published a document (SCCR/36/4) entitled “Next Steps on Other Matters”
prepared by the Chair (Daren Tang, Singapore) of the Standing Committee on
Copyright and Related Rights (SCCR). These other matters include: 1) the
Artist’s Resale Right, 2) Copyright in the Digital Environment, and 3)
Theatre Directors.

In relation to the Artist’s Resale Right, the Chair proposed:

"Discussion on the status of this agenda item, including the request from
some Member States to make it part of the standing agenda of the Committee.
The discussion would take into account the work that has been done on this
topicand the documents that are before the Committee.

The discussion could conclude with a discussion of future work, which could
include setting up a taskforce of experts to report back to Committee
regarding the practical elements of an ARR system. Possible topics include
(i) Categories of works of art that generate resale royalties; (ii)
Typology of acts to be covered by the resale right;(iii) Monitoring of
transactions, liability and financial aspects of the resale right; and (iv)
management of the resale right, including collective management."

With respect to copyright in the digital environment, the Chair proposed:

"Discussion to explore the suggestion of some Member States to undertake
studies, including economic studies and data analysis, to develop a deeper
understanding of the impact of digital technology on the ecosystem of
creative industries."

In relation to the Russian proposal on theatre directors, the Chair
proposed:

"The Russian Federation will be invited to provide a detailed description
of its proposal to be followed by a preliminary Committee discussion."

It is expected that the 36th session of the SCCR which meets from 28 May
2018 to 1 June 2018 will decide on the Committee’s future work program on
these aforementioned topics.
