[Ip-health] COVID-19 Vaccine Advance Purchases Explained (and defended with an IPR chaser)

It’s profoundly disappointing to see such an incomplete analysis from highly accredited researchers.
Firstly, they assume that successful vaccine candidates will able to supply sufficient quantities without any exploration whatsoever of their current estimates of manufacturing capacity even as companies are simultaneously entering into contract manufacturing agreements.  Similarly, they neglect to explain that those very agreements might at least temporarily limited extra manufacturing capacity for even better vaccine candidates.
Secondly, they say price will not be a problem without even discussing the prices that vaccine producers are currently projecting, with Moderna, for example, projecting prices as high as $74 per two-dose vaccination.  Other companies are charging $40, and only one coalition, Oxford/AstraZeneca is proposing a much more reasonable cost-of-production price of $3/dose.  The amounts of money involved might sound trivial to rich countries, but they will be prohibitive in low- and middle-income countries where 80% of the world’s population lives.  The author’s price analysis is particularly suspect because they don’t acknowledge the drop in global health assistance and the greatly reduced tax revenues of LMICs as they face an economic crisis on top of a COVID-19 crisis.
Thirdly, we get to the most problematic aspect of this blog – the stated topic of the paper on advance purchase agreements.  The authors focus almost entirely on “pull” effect of such agreements and their impact on incentivizing early investments in expanded manufacturing capacity and manufacturing “at risk” even before proof of safety and efficacy and marketing approval.  All well and good.  But the authors largely neglect the quantities of vaccines that have been reserved for rich countries, which by some estimates already exceed the global manufacturing capacity of COVID-19 vaccines through the end of 2021.  The authors give scant attention to the very real risk that vaccine nationalism will leave people in the Global South waiting in line and dying while rich countries vaccinate their entire population.  The Gavi COVAX Facility has nowhere near the resources needed to secure the 950 million doses it hope to reserve for LMICs.  Not only is that number inadequate to population need, but it’s by no means certain that COVAX reserving capacity this fall will result in access before 2022 unless rich countries and vaccine manufacturers agree to void existing commitments.  The idea that a National Academies study on equitable allocation will wake rich countries up to the moral outrage they are committing is a bit simplistic isn’t it?
Lastly, the authors for inexplicable reasons decide this is a good time to discredit compulsory licensing strategies, pulling out the old canard that CLs lessen innovation incentives and are unneeded at this time because patents are not a problem.  For countries that can’t get adequate supplies or affordable prices, coordinated compulsory licenses and even taking over manufacturing capacity might be the only way to overcome Pharma profiteering and artificial supply shortages.  Not only will countries need to overcome patent barriers, but they will also have to attack data exclusivities, trade-secret manufacturing know-how, and access to cell-lines and other biologic resources to enable the full technology transfer needed for the development of bio-identical vaccines.

No vaccine for the novel coronavirus has been approved anywhere. Who is pre-purchasing COVID-19 vaccines?

Other governments are also making advance purchases of yet-to-be-approved vaccines, particularly the UK and other European countries. How do these advance purchases affect vaccine innovation?

As we discussed last week<https://nam12.safelinks.protection.outlook.com/?url=https%3A%2F%2Fwrittendescription.blogspot.com%2F2020%2F07%2Fhow-should-policymakers-use-pull.html&data=02%7C01%7Cb.baker%40northeastern.edu%7Ca9ee4cdd354b40bbe73008d845e55e6a%7Ca8eec281aaa34daeac9b9a398b9215e7%7C0%7C0%7C637336199882074491&sdata=T5VZQRsdL3JzgnaQxn6IC6ONXul3VYNRL6cbNRU1iz8%3D&reserved=0>, pull incentives that increase or provide certainty about the expected ex post reward for a new technology are a crucial tool in the government’s arsenal for promoting innovation. Agreements to purchase a product before it actually exists in the world have successfully been used in the vaccine context to drive innovation. Gavi’s $1.5 billion advance market commitment (AMC) for a vaccine against pneumococcal disease<https://nam12.safelinks.protection.outlook.com/?url=https%3A%2F%2Fwww.gavi.org%2Ftypes-support%2Fvaccine-support%2Fpneumococcal&data=02%7C01%7Cb.baker%40northeastern.edu%7Ca9ee4cdd354b40bbe73008d845e55e6a%7Ca8eec281aaa34daeac9b9a398b9215e7%7C0%7C0%7C637336199882074491&sdata=4SaBNEDasPvjS%2FNLMtg1UXq5uf9HDanzttPV06jkif8%3D&reserved=0> has resulted in the immunization of over 180 million children. A few of the above-described arrangements are structured similarly to the pneumococcal AMC, although most of the reported investments in vaccine companies do not appear to be contingent on the success of their innovative efforts.

These COVID-19 vaccine agreements differ in at least three additional, key ways from this previous AMC or other innovation-promoting efforts. First, unlike with previous efforts to use pull incentives in the vaccine context, it is not at all clear that advance purchase commitments are needed to encourage companies to invest in the development of vaccines against COVID-19. COVID-19 is truly global in scale; there is an enormous potential market for the vaccine. There is also less concern that the disease will dissipate before a vaccine arrives, as COVID-19 is harder to contain than other diseases for which vaccines have been researched. With rarer conditions like Ebola<https://nam12.safelinks.protection.outlook.com/?url=https%3A%2F%2Fwww.uclalawreview.org%2Fip-preparedness-for-outbreak-diseases%2F&data=02%7C01%7Cb.baker%40northeastern.edu%7Ca9ee4cdd354b40bbe73008d845e55e6a%7Ca8eec281aaa34daeac9b9a398b9215e7%7C0%7C0%7C637336199882084487&sdata=jgcLCz3dnAhjeE2Ac%2BYEc6EAXXfMKh2fyBCPb%2B8QqkA%3D&reserved=0>, for instance, it is difficult to be sure that there will be enough patients to enroll in clinical trials, as traditional public health tools can successfully contain individual outbreaks of the disease. For other conditions, such as the particular strains of pneumococcal disease prevalent in low-income countries, there may not be a large enough developed-country market to encourage pharmaceutical company investment. Neither is true for COVID-19. Second, even if advance purchases are not needed to induce entry, they can still be valuable for increasing the speed of development. In particular, these agreements are designed to promote early investment in vaccine manufacturing, even before a vaccine candidate has demonstrated efficacy. These investments may be wasted in the event that a vaccine candidate fails, and so companies typically would not build this capacity so early in the development process. Here, however, there is enormous social value in enabling speedier access to a vaccine that has demonstrated safety and efficacy, justifying<https://nam12.safelinks.protection.outlook.com/?url=https%3A%2F%2Fwww.youtube.com%2Fwatch%3Fv%3DC8W8JQLTECc&data=02%7C01%7Cb.baker%40northeastern.edu%7Ca9ee4cdd354b40bbe73008d845e55e6a%7Ca8eec281aaa34daeac9b9a398b9215e7%7C0%7C0%7C637336199882084487&sdata=l%2B95A32kedUTZPUhHqEmMVx5Emic4304k3L1UZL1JHE%3D&reserved=0> the large government investments.

Third, governments are using these agreements to reserve doses for their citizens in a way that may lead to a lack of supply for other countries<https://nam12.safelinks.protection.outlook.com/?url=https%3A%2F%2Fwww.gavi.org%2Ftypes-support%2Fvaccine-support%2Fpneumococcal&data=02%7C01%7Cb.baker%40northeastern.edu%7Ca9ee4cdd354b40bbe73008d845e55e6a%7Ca8eec281aaa34daeac9b9a398b9215e7%7C0%7C0%7C637336199882094477&sdata=9EooWtJM7ntuGJTYZlPKcDJfaCiyQ3GL2HfuWPfjy5o%3D&reserved=0>, at least in the short term. These concerns over “vaccine nationalism,” as noted above, may raise grave concerns for equitable access to the vaccine where it could save the most lives. COVAX is a promising development to address this concern, although as of July 31, Gavi had raised only $600 million out of $2 billion<https://nam12.safelinks.protection.outlook.com/?url=https%3A%2F%2Fwww.gavi.org%2Fnews%2Fmedia-room%2F92-low-middle-income-economies-eligible-access-covid-19-vaccines-gavi-covax-amc&data=02%7C01%7Cb.baker%40northeastern.edu%7Ca9ee4cdd354b40bbe73008d845e55e6a%7Ca8eec281aaa34daeac9b9a398b9215e7%7C0%7C0%7C637336199882094477&sdata=otiC4D%2Fa5ZxJjMhpOk%2BcW%2FcbSqzMuMmF%2B90nUH77n7A%3D&reserved=0> in seed funding needed to secure doses for the 92 countries eligible for donor support. Is compulsory licensing of patents important to ensure adequate access?

Even with advanced market commitments, a number of scholars have voiced their concerns that patents will impede access to or development of COVID-19 vaccines. Professor Sapna Kumar, for example, has called for compulsory licensing by the federal government and generic importation by states<https://nam12.safelinks.protection.outlook.com/?url=https%3A%2F%2Fpapers.ssrn.com%2Fsol3%2Fpapers.cfm%3Fabstract_id%3D3636456&data=02%7C01%7Cb.baker%40northeastern.edu%7Ca9ee4cdd354b40bbe73008d845e55e6a%7Ca8eec281aaa34daeac9b9a398b9215e7%7C0%7C0%7C637336199882124462&sdata=Ob%2BFoD3XmPx0%2FudsJQJrZ%2BvDF8ydcdmn1GAZSNN2KP8%3D&reserved=0>. Evidence that patents were hindering development of COVID-19-related technologies or that patentees were restricting access to increase profits would help make the case for compulsory licensing during this pandemic. But as of yet, we are unaware of any such examples. As noted above, there are over 150 COVID-19 vaccine candidates in development—an astonishing number for a disease only discovered nine months ago. Clinical trials are already underway for more than two dozen of those. For these vaccines, there’s no evidence that IP is being used to frustrate competition or keep early-stage developers off the market. Nor would patents likely be used to restrict the supply of any successful vaccine. The developer of an effective coronavirus vaccine should maximize its profits (and good PR) by making and distributing as many doses as possible—including through licensing and transfers of know-how<https://nam12.safelinks.protection.outlook.com/?url=https%3A%2F%2Finvestors.modernatx.com%2Fnews-releases%2Fnews-release-details%2Fmoderna-and-lonza-announce-worldwide-strategic-collaboration&data=02%7C01%7Cb.baker%40northeastern.edu%7Ca9ee4cdd354b40bbe73008d845e55e6a%7Ca8eec281aaa34daeac9b9a398b9215e7%7C0%7C0%7C637336199882144453&sdata=LSuScka3r6nj8sbCz3s2uygSTU45Z3hPnizsKnkPYQk%3D&reserved=0> to other manufacturers, as they have begun to do. The real access concern, we think, is not that patents will lead to fewer doses being produced—it is that a distribution system principally managed by wealthy nations will fail to adequately distribute the vaccine to those most at risk.

Compulsory licensing doesn’t address these concerns. Whatever merits compulsory licensing offers for some basic pharmaceuticals, vaccines are quite different. In the small-molecule context, entry by numerous generic manufacturers is relatively inexpensive and can rapidly increase supply.
