It would be interesting to read the commercial supply agreement with the manufacturer of the valves, and what liability the manufacturer has in the event it fails to supply required components. In other words, file a breach of contract action as a counter to any attempt to enforce patent rights. (One could also stipulate to infringement in return for disgorging all profits — which in this case would mean no damages since there were no profits.)
